Whom These Presents Shall Come, Greeting: Know Ye, That We, Rose H. Fulton and Margery K. Hayden,
both of the town of Waterbury, County of New Haven, and the State of Connecticut, in
consideration of the acceptance by the City of Waterbury, a municipal corporation of said
NewHaven County, of our offer of April 18, 1921 to convey to said City of Waterbury, for
park purposes only, the land herein conveyed, and the agreement of said Waterbury to carry
out and perform the conditions stipulated in said offer, do by these presents, release,
remise and for-ever QUIT-CLAIM unto the said City of Waterbury, it's successors and assign
forever, upon the conditions herein stipulated, all right, title, interest, claim and
demand whatever, which we, the said Releasors, have or ought to have in or to said certain
piece of land situated in said Waterbury and bound and described as follows:
Beginning on the northerly line of Grove Street at the southerly
corner of land of the City of Waterbury;
thence northerly in the easterly line of land of the City of
Waterbury 278.08 feet to land of Darragh De Lancey;
thence easterly in the southerly line of said De Lancey 85 feet
to a monument;
thence deflecting to the right an angle of 49° 57' and a
distance of 22.66 feet to the northwesterly corner of land formerly of Hayden W. Brown;
thence deflecting to the right an angle of 49° 42-1/2' and in
the westerly line of land formerly of said Brown 23.95 feet to a monument;
thence deflecting to the left an angle of 91° 10' and in the
southerly line of land formerly of said Brown 223.27 feet to land now or formerly of Louis
Archambault;
thence deflecting to the right an angle of 99° 33' and in the
westerly line of land of said Archambault 17.19 feet;
thence deflecting to the left an angle 80° 09-1/2' and in the southerly line of land of
said Archambault 57.4 feet to the land of the First Baptist Church;
thence at right angles to the last described line and in the
westerly line of land of said Church 208 feet to a monument;
thence deflecting to the left an angle of 23° 42' and in the westerly line of land of
said church 49.69 feet to Grove Street;
thence westerly in the southern line of Grove Street 316.02 feet to the place of
beginning.
Said land is conveyed
by the Releasors and is to be held by the Releasee upon the following conditions,viz:
That the name of the park shall
always be the "Hayden Homestead Park".
That the said park shall be laid
out and improved approximately, in accordance with the plans submitted by the releasors
April 18, 1921, and that the reasonable appropriations be made within a reasonable time
for carrying out the plans.
That the property shall always be
used for park purposes, not for a playground and that no buildings, monuments or memorials
shall be erected thereon except with the consent and approval of the Releasors or their
heirs, that a caretaker be provided therefore and the grounds be well-lighted and policed
at night.
That some connection be provided
between the park and the Wilby High School, and that a gateway be maintained between the
park and #230 Grove Street property for the sole use of the occupants of that property.
That in case the city shall at any
time fail to fully perform said conditions imposed upon it, said property shall forwith
revert to the Releasors or their heirs.
To Have And To
Hold, the premises, with all the appurtenances unto the said
Releasee, the said City of Waterbury, its successors and assigns forever upon the
conditions above enumerated; so that neither of the Releasors nor their heirs nor any
person claiming under them, shall hereafter have any claim, right or title in or to the
premises, or any part thereof, except as herein stipulated, but therefrom they are by
these presents forever barred and secluded, as aforesaid.
